Terms of Use

1. Acceptance

By accessing GunSearchEngine.com, using Betsy chat or alerts, loading our dealer embed, or using Brand Intelligence APIs or portals, you agree to these Terms and our Privacy Policy. If you use the service on behalf of a company, you represent you have authority to bind that company.

2. The service

We provide AI-assisted product search over participating dealer feeds, optional email/alert continuity, dealer embed widgets, aggregated demand insights, and (for invited customers) Brand Intelligence demand data and APIs. We are not a firearms dealer, FFL, manufacturer, or background-check provider. We do not complete transfers or Form 4473 workflows. Product availability, pricing, and legality of purchase remain between you and the selling retailer.

3. Lawful use only

You may use the service only for lawful purposes and in compliance with all applicable firearms, ammunition, export, sanctions, and privacy laws. You must not use the service to facilitate illegal acquisition, straw purchasing, or evasion of dealer compliance. We may suspend access for abuse, fraud, or legal risk.

4. Accounts & keys

• Shopper magic-link and enterprise passwords/API keys are credentials you must protect.
• Enterprise ek_live_ secrets are shown once; treat them as production secrets.
• You are responsible for activity under your credentials and for timely revocation when staff leave.

5. Catalog & accuracy

Inventory, prices, and stock are supplied by third-party feeds and may be delayed, incomplete, or wrong. MAP and restricted listings may be hidden or demoted. Betsy replies and demand analytics are informational tools—not legal, tax, or purchasing advice. Always confirm on the retailer's site before purchase.

6. Brand Intelligence data

Enterprise demand data is anonymized/sanitized as described in the API docs and methodology materials. Residual free-text fields (for example search q) and referrer hosts may still appear. You must not attempt to re-identify individuals, join exports with personal data from other sources for identification, or resell raw session extracts without our written permission. OEM editions are limited to configured brand scope; empty OEM scope fails closed.

7. Dealer embeds

Dealers must install embeds only on origins they control and that match configured allowlists. Catalog search in embed mode is scoped to that seller. Host-page intent capture is for demand and product improvement as described in the Privacy Policy.

8. Intellectual property

The service, Betsy persona, software, and branding are owned by us or our licensors. Dealer product content remains the dealer's or brand's. You receive a limited, revocable right to use the service as offered—not a sale of software.

9. Availability

We aim for reliable operation but do not guarantee uninterrupted uptime, feed freshness, or AI response quality. Features may change. Paid enterprise SLAs, if any, are only those written in a separate order form or MSA.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Limitation of liability

To the maximum extent permitted by law, we and our suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill, arising from use of the service. Our aggregate liability for claims relating to the service is limited to the greater of (a) amounts you paid us for the service in the 12 months before the claim or (b) one hundred U.S. dollars ($100), except where liability cannot be limited by law.

12. Indemnity

You will defend and indemnify us against claims arising from your unlawful use of the service, your product content (if you are a seller), or your misuse of Brand Intelligence data.

13. Termination

We may suspend or terminate access for breach, risk, or operational reasons. You may stop using the service at any time. Provisions that by nature should survive (IP, disclaimers, liability limits) survive termination.

14. Governing law

These Terms are governed by the laws of the State of South Carolina, USA, excluding conflict-of-law rules, unless a signed enterprise agreement says otherwise. Venue for disputes will be state or federal courts located in Greenville County, South Carolina (or the federal district covering Greenville, SC), subject to mandatory consumer protections where applicable. Counsel should confirm venue/entity details for final form.
